وَمِنۡ اَهۡلِ الۡكِتٰبِ مَنۡ اِنۡ تَاۡمَنۡهُ بِقِنۡطَارٍ يُّؤَدِّهٖۤ اِلَيۡكَ‌ۚ   وَمِنۡهُمۡ مَّنۡ اِنۡ تَاۡمَنۡهُ بِدِيۡنَارٍلَّا يُؤَدِّهٖۤ اِلَيۡكَ اِلَّا مَا دُمۡتَ عَلَيۡهِ قَآٮِٕمًا ‌ؕ   ذٰ لِكَ بِاَنَّهُمۡ قَالُوۡا لَيۡسَ عَلَيۡنَا فِىۡ الۡاُمِّيّٖنَ سَبِيۡلٌۚ  وَيَقُوۡلُوۡنَ عَلَى اللّٰهِ الۡكَذِبَ وَ هُمۡ يَعۡلَمُوۡنَ

 

Wa-min-aah-lil-kay-taa-bay-mun-in-tau-mun-ho                                                                        Bay-qin-taa-rin-yo-ud-day-he-elai-ka                                                                                            Wa-min-hoom-mun-in-tau-mun-ho                                                                                                  Bay-de-naa-rin-laa-yo-ud-day-he-elai-ka                                                                                        Il-laa-maa-doom-ta-alai-hay-qaa-aiy-maa                                                                                     Zaa-lay-ka-bay-un-na-hoom-qaa-loo                                                                                               Lai-sa-alai-naa-fil-oom-me-yee-na-sa-bee-l                                                                                 Wa-ya-qoo-loo-na-alul-laa-hil-ka-zay-ba-wa-hoom-yau-la-moo-n

           

And among the People of Book is he who if you entrust him                                      With a big treasure he will return it to you.                                                                       And among them is he who if you entrust him                                                                  With a penny he will never return it to you                                                                        Unless you continue standing firm on it.                                                                             This is because they had said,                                                                                                   “On us is no cause in regard to the Uneducated                                                            And they tell a lie on Allah and they know full well.”

  • مَنۡ — Mun — Who (= Anyone; whoever; whom; whomever; whoso)
  • اِنۡ  — In — If (= In case; when; when situation arises; whenever)
  • تَاۡمَنۡ — Tau-mun — You entrust (= Give, put or place something in trust; trust them)
  • هُ  — Ho — Him (= pro., s., m., 3rd person. Refers to anyone among the People of the Book)
  • بِ  — Bay — With (= Literally the word  بِ  means ‘with’)
  • قِنۡطَارٍ — Qin-taa-rin — Big treasure (= A great amount, heap or hoard of gold or wealth. A weight of treasure. A huge treasure. The word represents    a talent of 1200 ounces of gold. See 003:015)
  •   يُّؤَدِّ — Yo-ud-day — He will return  (= Faithfully, happily, readily, voluntarily and willingly discharge the trust, give and pay back or return intact. Surrender it back)
  • هٖۤ — He — It (= pro., s., m., 3rd person. Refers to the property entrusted)
  • اِلَيۡ — Elai — To (= In the direction of; to; towards)
  • كَ — Ka — You (= pro., s., m., 2nd person. You single male. See the note under 002:005)
  • وَ — Wa — And (= Conj., links words, phrases or clauses. See وَ  above)

  • قَآٮِٕمًا — Qaa-aiy-mun — Stand firm (= Keep claiming, demanding firmly, insisting or pressing for the return of the dinar placed in trust)
  • ذٰلِكَ — Zaa-lay-ka — This (= Here; refers to an aforesaid fact, person or statement; it was because; right here; such is this; that is how it is
  • بِ — Bay — With (= Literally the word  بِ  means ‘with’)
  • اَ نَّ — Un-na — Surely (= Absolutely; certainly; definitely; positively; verily)

  • قَالُوۡا — Qaa-loo — They said (= v., past t., pl., m; 3rd person: Announced; broadcast;  conveyed; declared; insisted; maintained; persisted; professed; specified; told)
  • لَـيۡسَ — Lai-sa — No (= Never; not; not all; absolute and total negation)
  • عَلَيۡ — Alai —  On (= Above; against; before; for; on top of; over; to; upon. Implied meanings in this verse is the false claim of owing no “blame, burden, liability, responsibility‘)
  • نَآ — Naa — Us (= pro., m & f., pl., 1st person. All of us; our; us all)
  • فِىۡ — Fee…(il) — In regard to (= In; concerning; in reference, relative to)
  • الۡاُمِّيّٖنَ — Oom-me-yee-na — Uneducated (= Gentiles; ignorant; illiterate; pagans; unenlightened; uncouth; unlearned; unlettered; unschooled. A/t/a, “Not of Jewish race” – Allamah Nooruddin. “(A)ny other than” – Ahmad Zidan
  • سَبِيۡلٌۚ — Sa-bee-l — Cause (= Blame; call; duty; obligation; responsibility. A correct,  appropriate, proper, right or straight course, direction,  highway, line, passage, path, road, route or way to conduct the affairs of life)

           * Note 003:076. This verse highlights an important aspect of the Law of Mortgages. The basic issues regarding mortgages have been dealt extensively in verses 002:283 and 002:284.

The pronouns  هِ  and  هٖۤ  refer to the entrusted dinar. It is the trust or security which is invariably something inanimate. They do not refer to the trustee of that trust as has been done in some translations. Trustee, lender or mortgagee refer to the person from whom the trust property is due to be redeemed and returned.

Even a bad faith foreclosure argument by Shylock-type loan shark is recognized by Law. The Anglo-Saxon law with an astronomical slant favor the mortgagee. Most known legislation, precedents and actual or fictional stories in literature underscore the rights of a mortgagee.

Little leniency exists for the mortgagor. Equity of Redemption is flouted everywhere. Despite a lip-service recognition of the principle, common law and prevailing practices permit a lender to dig his claws deep into his borrower’s possessions and almost everything he owns.

The borrower, mortgagor or provider of security had few protections to his rights in his own assets that he was forced to mortgage. Scriptures took the lead to cut a trustees’ well-known highhandedness. This verse is a pioneering safeguard which modern trend is now following.

The pronouns هِ and هٖۤ do not refer to the trustee. It is not realistic for a borrower to keep standing over his claim for the return of his security. This verse highlights his right to get back his property he gave in trust. It remains alive and active until his property is restored to him.
