وَلَـقَدۡ اَرۡسَلۡنَا مُوۡسٰى بِاٰيٰتِنَاۤ اَنۡ اَخۡرِجۡ قَوۡمَكَ مِنَ الظُّلُمٰتِ اِلَى النُّوۡرِ ۙ وَذَكِّرۡهُمۡ بِاَيّٰٮمِ اللّٰهِ‌ؕ اِنَّ فِىۡ ذٰ لِكَ لَاٰيٰتٍ لّـِكُلِّ صَبَّارٍ شَكُوۡرٍ‏

Wa-la-qud-ur-sul-naa-moo-saa-be-aa-yaa-te-naa-un-ukh-rij-qao-ma-ka–me-nuz-zo-lo-maa-te-elun-noor–wa-zuk-kir-hoom-be-ayyaa-mil-laah–inna-fee-zaa-le-ka-la-aa-yaa-tin-le- kool-lay-sub-baa-rin-sha-koor.

And We certainly sent Moses with our signs saying “Take your people out of the Darkness to the Light. And remind them of the annals of Allah.  Most certainly in that are the signs for all persistent (persons and)  grateful (guys.)

  • وَ — Wa — And (= Conj., links words, phrases or clauses; additionally; but; also; more over; though; when; while; yet; whereupon)
  • لَ — La — Certainly (= Absolutely; definitely; positively; surely; truly; verily)
  • قَدۡ — Qud — Surely (= Lays emphasis as by absolutely; categorically certainly

  • اَرۡسَلۡ — Ur-sul — Sent (= Appointed; dispatched; deputed. raised; set up)
  • نَآ — Naa –We (= pro., pl., m & f genders.,1st person; Refers to ‘us all’. If
    used with God’s name it reflects the authoritative way a higher-up talks to a subordinate which IS the case here)
  • مُوۡسٰى — Moo-sa — Moses (= The name of a Messenger / Prophet of Allah)
  • بِ — Be — With (= This word in Arabic literally means ‘with’)
  • اٰيٰتِ — Aa-ya-te — Signs (= n., pl. 1. Narratives; revelations; verses. 2. Commands; directions; laws; orders. 3. Corroborations; evidence; indications; lessons; manifestations; messages; pointers; portents; proofs; symbols; tokens. 4. Parts, portions, proofs or signs that point to the truth. 5. All elements to create a clear crystal picture leading to an absolute conviction)

  • مِنَ — Me…(nuz) — From (= Out from the class, category, count, kind or person of)
  • الظُّلُمٰتِ — Zolo-maa-te — The darkness (= n., Literally, ‘layer upon layer of darkness’; abysmal darkness; depth of darkness; several zones of thick, total and utter darkness. Physical and spiritual darkness)
  • اِلَى — El…(un) — To (= In the direction of; towards; with)
  • النُّوۡرِ — Noor — The Light (= Brightness; illumination; shine)
  • وَ — Wa — And (= Conj., links words, phrases or clauses; additionally; but; also; more over; though; when; while; yet; whereupon)
  • ذَ كِّرۡ — Zuk-kir — Remind (= Let them recall and remember; refresh their memory)
  • ھُمۡ‌ — Hoom — Them (= pl., m., in 3rd person. Refers to all the aforesaid shown,
    specified or stated articles, things or persons)
  • بِ — Be — With (= This word in Arabic literally means ‘with’)
  • اَيَّامٍ — Ayyaa-m..(il) — Annals (= pl., 1. Archives; records; chronicles; history. 2. Days; ends of several periods, terms or times; junctures)
  • اللّٰهِ — Alla-hay — Allah (= The Almighty God; the One Only worthy of worship)
  • اِنَّ  — Inna — Certainly ** (= Absolutely; definitely; doubtlessly; earnestly; indeed; in all seriousness; positively; really; surely; truly; verily)
  • فِىۡ — Fee — In (= 1. Contained inside or amidst a duration, event, time, place, period, thing or situation. 2. Concerning; for the sake of; in reference, relative or pursuant to; regarding)
  • ذٰلِكَ — Zaa-le-ka — That (= It. It was because. Right here. Such is. This. That’s how it is. Refers to aforesaid fact, person or statement)
  • لَ — La — Certainly ** (= Absolutely; definitely; positively; surely; truly; verily)
  • اٰيٰتٍ — Aa-ya-tin — Signs (= n., pl. 1. Narratives; revelations; verses. 2. Commands; directions; laws; orders. 3.   • لِ — Lay — For (= For the benefit, purpose or reason; on account of; with intent to or object of)
  • كُلِّ — Kool-lay — All (= Altogether; each and everyone; entirely; everything without exception; totally; wholly)
  • صَبَّارٍ — Sub-baa-rin — Persistent (= superlative form., Consistent; constant; firmly patient;  pursuant; steadfast; who keep on repeating continually and regularly; those who show fortitude by patiently persevering)
  • شَكُوۡرٍ — Sha-koor — Grateful (= Appreciative; ingratiated; thankful)

** Note: Two Arabic words اِنَّ and لَ have very similar meanings. They are used in the same one clause or sentence to create extreme emphasis. The English equivalents for both the words are almost the same. Instead of using the same word twice (‘certainly’, certainly’) in the translation of the same one verse, a more appropriate expression ‘most certainly’ has been used because that conveys better the real intent of the original text clearly. Extreme emphasis has been created this way in many places in the Holy Qor-aan. Examples including this verse can be seen in 014:008, 092:005, 100:007, 100:006; 100:009, 100:012; 103:003.

اُولٰٓٮِٕكَ الَّذِيۡنَ اشۡتَرَوُا الۡحَيٰوةَ الدُّنۡيَا بِالۡاٰخِرَةِ‌ فَلَا يُخَفَّفُ عَنۡهُمُ الۡعَذَابُ وَلَا هُمۡ يُنۡصَرُوۡنَ

             Olaa-ekul-la-zee-nush-ta-ra-wool-ha-yaa-tud-doon-ya-bil-aa-khay-ra-tay-fa-laa-yo-khuf-fa-un-ho-mool-azaa-bo-wa-laa-hoom-yoon-sa-roo-n.

             These people are those who traded the life here for that of the Hereafter.   Their punishment will not be reduced.   And they will not be helped.

  • اُولٰٓٮِٕكَ — Olaa-eka..(ul) — These people (= All such facts, persons or things)
  • ٱلَّذِينَ — La-zee-n..(ush) — Those who (= pl., m, 3rd person. All those articles, things or persons)
  • اشۡتَرَوُا — Sh-tara-woo(l) — Traded (= 1. Bartered; bought at or paid the price; purchased; trafficked. 2. Chosen, preferred this life over that of the Hereafter; bought this life for the price of the Hereafter)
  •  الۡحَيٰوةَ — Ha-yaa-t..(ud) — Life (= The quality shown by functions among others of growth and response to stimulation and reproduction by which living organisms are distinguished from dead organisms and inanimate matter)
  • ٱلدُّنۡيا — Doon-yaa — Here (= At hand; close at hand; near; on earth; present; short term; of this world. Hither, the opposite of the Hereafter)
  • بِ — B…(il) — With (= The Arabic word بِ literally means ‘with.’ Also, ‘at or for the price of’, ‘in exchange’ and ‘in preference to’)
  • الۡاٰخِرَةِ — Aa-khay-ra-tay –The Hereafter (= Coming. Future. Judgment Day. Resurrection. The end. Life – after death, ahead, later, next, yet to come later.
    Succeeding hour. Something in the far distant. Time ahead, in future, yet to come; The Last or other world)
  • فَ –Fa –Then (= Consequently; as a result; so; thereafter; therefore; yet)
  •  لَا– Laa — No, not (= Absolute denial; never; not at all; total negation)
  • يُخَفَّفُ — Yo-khuf-fo –Reduced (= Decreased; diminished; lessened; lightened)
  • عَنۡ — Un — About (= Concerning; regarding; relative to)
  • هُمُ — Ho-mo…(ol) — Them (= pro., pl., m., 3rd person.  Refers to aforesaid persons )

وَمَاۤ اَرۡسَلۡنَا مِنۡ رَّسُوۡلٍ اِلَّا بِلِسَانِ قَوۡمِهٖ لِيُبَيِّنَ لَهُمۡ‌ؕ فَيُضِلُّ اللّٰهُ مَنۡ يَّشَآءُ وَيَهۡدِىۡ مَنۡ يَّشَآءُ‌ ؕ وَهُوَ الۡعَزِيۡزُ الۡحَكِيۡمُ‏

Wa-maa-ur-sul-naa-mir-ra-soo-lin-illaa-be-le-saa-ne-qao-me-hee-lay-yo-buy-yun-na- -la-hoom–fa-yo-dzil-lul-laa-ho-mun-ya-shaa-o–wa-yuh-dee-mun-ya-shaa-o–wa-ho-wul-aze- zool-hakeem

And We never raised a messenger except in the tongue of his people to explain to them Our message. Then He lets him go astray whom He wills and guides him whom He wills. And He is the Mightiest, the Wisest.

    The Highest; most elevated, honored and respected.
    All-Mighty. Exalted in might and the power. Mightiest. This one word has the meanings of might with respect)
  • ٱلۡحَكِيمُ — Ha-keem — The Wisest (= superlative form indicates the greatest, the highest, the most and highlights that none more than Him is Exalted in wisdom. Best Possessor of wisdom. Extremely shrewd.
    Full of wisdom. The Wisest)

ثُمَّ اَنۡـتُمۡ هٰٓؤُلَاۤءِ تَقۡتُلُوۡنَ اَنۡفُسَكُمۡ وَتُخۡرِجُوۡنَ فَرِيۡقًا مِّنۡكُمۡ مِّنۡ دِيَارِهِمۡؕ تَظٰهَرُوۡنَ عَلَيۡهِمۡ بِالۡاِثۡمِ وَالۡعُدۡوَانِؕ وَاِنۡ يَّاۡتُوۡكُمۡ اُسٰرٰى تُفٰدُوۡهُمۡ وَهُوَ مُحَرَّمٌ عَلَيۡڪُمۡ اِخۡرَاجُهُمۡ‌‌ؕ اَفَتُؤۡمِنُوۡنَ بِبَعۡضِ الۡكِتٰبِ وَتَكۡفُرُوۡنَ بِبَعۡضٍ‌ۚ فَمَا جَزَآءُ مَنۡ يَّفۡعَلُ ذٰلِكَ مِنۡکُمۡ اِلَّا خِزۡىٌ فِى الۡحَيٰوةِ الدُّنۡيَا ‌ۚ وَيَوۡمَ الۡقِيٰمَةِ يُرَدُّوۡنَ اِلٰٓى اَشَدِّ الۡعَذَابِ‌ؕ وَمَا اللّٰهُ بِغَافِلٍ عَمَّا تَعۡمَلُوۡنَ

 

Thoom-ma-un-toom-haa-olaa-aiy-tuq-to-loo-na-un-fo-sa-koom
Wa-tookh-ray-joo-na-fa-ree-qum-min-koom-min-day-yaa-ray-him
Ta-zaa-ha-roo-na-alai-him-bil-ith-may-wul-ood-waan
Wa-in-yau-too-koom-osa-raa-to-faa-do-hoom
Wa-ho-wa-mo-hur-ra-moon-alai-koom-ikh-raa-jo-hoom
Aa-fa-tou-may-noo-na-bay-bau-dzil-kay-taa-bay
Wa-tuk-fo-roo-na-bay-bau-dzin
Fa-maa-ja-zaa-o-mun-yuf-aa-lo-zaa-lay-ka-min-koom
Il-laa-khiz-yoon-fil-ha-yaa-tid-doon-yaa
Wa-yao-mul-qay-yaa-ma-tay-yo-rud-doo-na-elaa-aa-shud-dil-azaa-bay
Wa-mul-laa-ho-bay-ghaa-fay-lin-um-maa-tau-ma-loo-n.

 

Then you were the very people killing some of yourselves
And expelling a group among you from their homes
Overpowering* them with sin and aggression.
And if they come to you as captives you pay for them
And expelling them was unlawful for you in the first place.
Do you then believe in one part of the Book
And you reject some other?
So what (or no) penalty is there for anyone among you
Who does that except humiliation in the life here
And on Judgment Day they will be turned over to severe punishment.
And Allah is not unmindful relative to what you do.

  • تَقۡتُلُوۡنَ — Tuq-to-loona — Killing (= v., Persecuting. Oppressing. Suppressing. Destroying. Engaged in battle, combat or war. Commit carnage, massacre, mayhem, murder, slaughter or slaying. See Commentary titled as Jihad, Is it Fighting)
  • اَنۡفُسَ — Un-fo-sa Selves — (= pl., Brethren, folks, kinsman or people. Group of hearts, individuals, minds, persons and souls. Countrymen, fellows, followers, individuals, nation or tribes)
  • کُمۡ — Koom — You (= pro., pl.,  m., 2nd person. You. The reference is to the بَنِىۡٓ اِسۡرَآءِيۡلَ. The Holy Qor-aan and other scriptures state that way when they address both men and women

  • تَظٰهَرُوۡنَ — Ta-zaa-ha-roo-na — Overpowering (= Aiding, abetting, assisting, backing, committing excess or supporting and inciting one group against another in broad-day light [openly getting an upper hand, overpowering, overcoming, overshadowing, prevailing upon and transgressing] or in hiding [by conspiring and cooperating secretly, surreptitiously and under-handedly] See also 060:010)

The first word عَنۡ (un) means about, concerning, regarding, relative to. The second word مَاۤ (maa) means all that or what. عَمَّا means about, concerning, regarding that or what. A/t/a, ‘what,’ ‘that which,’ ‘all the things,’ ‘that’ and ‘all that (evil)’
  • تَعۡمَلُوۡنَ — Tau-ma-loo-na — You do (= v., pres., pl., 2nd person. Act; activate; attempt; carry out; effect; exercise; execute; function; go; make out; implement; operate; perform; practice; render; serve; run-through; work-out. See Note 002:075b)

 

* Note 002:086. The words تَظٰهَرُوۡنَ عَلَيۡهِمۡ mean the following.
1. Backing up one another against your own, or the enemy.
2. Committing excess and conspiring by aiding, abetting, assisting & supporting [the enemy against your own folks.
3. Getting the upper hand, overcoming, prevailing on or transgressing against your own.

However, those words have been translated quite differently as shown below. Several Translators have applied those actions a) to some Israelites, or b) to one group of Israelites against others, or c) to some Israelites against the enemy, or d) to the enemy against the fellow Israelites.

Wa-iz-aa-khuz-naa-me-thaa-qa-koom
Laa-tus-fay-koo-na-day-maa-aa-koom
Wa-laa-tookh-ray-joo-na-unfo-sa-koom-min-day-yaa-ray-koom

And remember when We took your Pledge

وَاِذۡ اَخَذۡنَا مِيۡثَاقَ بَنِىۡٓ اِسۡرَآءِيۡلَ لَا تَعۡبُدُوۡنَ اِلَّا اللّٰهَ وَبِالۡوَالِدَيۡنِ اِحۡسَانًا وَّذِى الۡقُرۡبٰى وَالۡيَتٰمٰى وَالۡمَسٰکِيۡنِ وَقُوۡلُوۡا لِلنَّاسِ حُسۡنًا وَّاَقِيۡمُواالصَّلٰوةَ وَاٰتُوا الزَّکٰوةَ ؕ ثُمَّ تَوَلَّيۡتُمۡ اِلَّا قَلِيۡلًا مِّنۡکُمۡ وَاَنۡـتُمۡ مُّعۡرِضُوۡنَ‏

 

Wa-iz-aa-khuz-naa-mee-thaa-qa-ba-nee-is-raa-ee-la
Laa-tau-bo-doo-na-il-lul-laa-ha
Wa-bil-waa-lay-dai-nay-aih-saa-nun
Wa-zil-qoor-baa-wul-ya-taa-maa-wul-ma-saa-kee-nay
Wa-qoo-loo-lin-naa-say-hoos-nun
Wa-aa-qee-moos-sua-laa-ta-wa-aa-tooz-za-kaa-ta

And recall when We took the Pledge from all children of Israel
“You worship none except Allah.
And treat with kindness the parents
And the kindred and the orphans and the poor.
And speak to the people of good things.
And establish the prayer and bring about the purification of earnings.”
Then you turned away except a few of you.
And you were averse to fulfill the Covenant.

* Note 002:084a.   The first 5 words وَاِذۡ اَخَذۡنَا مِيۡثَاقَ  in verses 002:064, 002:085 and 002:094 are the same.   They remind the addressees of a Covenant whereby the Almighty God conferred certain special favors upon the Children of Israel and mandated on them specific task to perform.   Nearly 2,600 years history as of today shows that the House of Israel has been blessed time and again even after their violating their Covenant and not doing the assigned tasks.   Some terms of the pledge with added perfections (005:004) are mandated on Moslems (002:178, 031:015/016).

** Note 002:084b.   Two of the tasks اَقِيۡمُوا الصَّلٰوةَ وَاٰتُوا الزَّکٰوةَ mentioned in verse 002:044 and repeated and repeated several times (See Note to verse 002:044 and our Commentary “Islam – Zakaat“) are to establish the prayers and purify one’s earnings by paying a part thereof for good causes.   Jews were commanded that way first.  Moslems are commanded exactly that way too.    The logical question raised in our Commentary Are Jews and Moslems alike, therefore, is that should not Moslems be also subject to  similar rewards and retributions.   Our answer is a big YES.

The Covenant besides the above-mentioned two components included the following.
1. Worship none except Allah.
2. Treat with kindness the parents, relatives, orphans and the poor.
3. Speak to the people of good things.

وَالَّذِيۡنَ اٰمَنُوۡا وَعَمِلُوا الصّٰلِحٰتِ اُولٰٓٮِٕكَ اَصۡحٰبُ الۡجَـنَّةِ ‌‌ۚ هُمۡ فِيۡهَا خٰلِدُوۡنَ

 

Wa  aul-la-ze-na  aa-ma-noo  wa  aa-may-loo  s-saa-lay-haa-tay                                             O-laa-aiy-ka  aus-haa-bo  ol-jaun-na-tay  hoom  fee  haa-khaa-lay-doo-n

 

And those who believed and practiced proper acts
All are the people of Paradise. They are dwellers in it perpetually.

  • وَ — Wa — And (= Conj., It links words, phrases or clauses; additionally; but also; more over; though; when; while; yet; whereupon)
  • عَمِلُوا — Aa-may-loo … (s) — Practiced (= v., past., pl., 3rd person. Acted; carried out; did; kept up; followed; led; lived out; performed; practiced; pursued; persisted in; strived. The Holy Qor-aan has used both verbs  اٰمَنُوۡا  and  عَمِلُوا  in the past tense but many authors inaccurately translated them in the present tense or as noun [O ye who believe; one author as ‘Believers’] as shown in Note 002:026c  )
  • الصّٰلِحٰتِ — Saa-lay-haa-tay — Proper acts (= n., pl., Appropriate, befitting, correct, decent, fit, good, holy, honorable, moral, pious, proper, respectable, right righteous, upright, virtuous or worthy acts, activities, deeds, manners, operations, practices, performances, pursuits or righteousness or works. Righteous actions which are appropriate in manner, time and place — not the likes of a soldier who stands up for a prayer during a sword-fighting battle for life and death)

Phrase O-laa-aiy-ka  aus-haa-bo  ol-jaun-nah … They are people of Paradise

Ba-laa  mun  ka-sa-ba  suy-yay-aa-ton
Wa  aa-haa-tut  bay  he  kha-tee-aa-to  hoo
Fa  o-laa-aiy-ka  us-haa-bo  on-naa-ray  hoom  fee  haa-khaa-lay-doo-n

Yes, whoever did a bad act
And was surrounded with his sins
Then they all are inmates of Fire. They are dwellers in it.

  • سَيِّئَةً — Suy-yay-aa-ton — A bad act  *  (= n., s., An evil, crime; error, illegality, misdeed, mistake, occurrence or wrong — done accidentally or forgetfully without much premeditated intention.   Generally used for a single unintended accidental occurrence)

  • خَطِيْۤـــَٔتُ — Kha-te-aa-to — Sins  *  (= n., pl., Multiple and repeatedly done evil acts, crimes, illegalities or sins committed with solid premeditation, firm intentions or sound determination. Not generally used for an error or mistake occasioned accidentally, forgetfully and unintentionally)
  • هٗ — Hoo — His (= pro., s., m., 3rd person. Here, the reference is to the doer of the bad act pinpointed by the verb كَسَبَ )
  • فَ — Fa — Then (= Consequently; as a result; so; thereafter; therefore; yet)

See Phrase O-laa-aiy-ka  us-haa-bo  on-naar … meaning “They are inmates of Fire”

  • اُولٰٓٮِٕكَ — Olaa-aiy-ka — They all (= Aforesaid facts, persons or things. Here the reference is to aforesaid folks, people, sinners and wrong doers)
  • اَصۡحٰبُ — Us-haa-bo … (on) — Inmates (= n.pl., This one word has many shades of meanings.   With closeness as an element … Associates; companions; families; fellows; folks; friends; heirs.  With residence as an element … citizens; denizens; dwellers; guests; inmates; inhabitants; invitees; live ins; natives; residents; stayers; visitors. With control as an element … army; controllers; fighters; masters; occupants; occupiers; owners; people; populace; population; possessors; soldiers)
  • ٱلنَّارِ — Naa-ray — The Fire (= Anger, punishment or wrath of Allah; hell; hell fire; purgatory. The Fire of punishment. Literally, the rapid sustained reaction or source of releasing light and heat)
  • هُمۡ‌ — Hoom — They (= pro., pl., m., 3rd person. Refers to aforesaid inmates)
  • فِىۡ   — Fee — In (= Contained in or amidst a duration, event, time, place, period, thing or situation; inside)
  • هَا — Haa — It (= pro., s., f., 3rd person., Refers to the fire)
  • خٰلِدُوۡنَ — Khaa-lay-doo-n — Dwellers (= n., pl., Those abiding, living, staying or residing for a time unspecified as in a hospital or rest house. To add words like everlastingly, for ever after, permanently and perpetually is inappropriate for those who will go   to hell. Adding such a qualification is appropriate only for the residents of Paradise . Some interpreters have incorrectly labeled this period to last forever. See Note 002:040)

* Note 002:082. This verse enumerates two kinds of wrongs. Verse 002:287 provides a prayer that pinpointedly covers both these types.

  • The first term used in verse 002:287 is  نَّسِيۡنَاۤ  (na-see-naa = we forget) and covers the mistakes described as سَيِّئَةً (suy-ye-atun) i.e., “A single bad or evil act, crime, deed, error, illegality, mistake, occurrence or wrong done accidentally or forgetfully without much premeditated intention.”
  • The second term used in verse 002:287 is  اَخۡطَاۡنَا  (akh-tau-naa = our sins) and covers the sins described as خَطِيْۤـــَٔتُ (kha-te-ato) i.e., “The multiple and repeatedly done evil acts, sins, crimes, felonies or illegalities committed with solid premeditation, firm intention or sound determination.” Abraham whom God set up as the Best Exemplar [060:005] also used this word [026:083] in praying for his own forgiveness.   خطَا in Arabic is generally not used for mistakes that occur accidentally, forgetfully or unintentionally.
  • Yet some translations of the word   خطَا   such as in 026:083 have stated them to be merely faults which appear to run counter to the distinction set up in the two terms used in the aforesaid payer in verse 002:287.   The fact is that both the verses 002:287 and 026:083 are prayers.   They are simple and straightforward on their own as well overwhelmingly overlap with each other without any contradiction.   Therefore, any translation showing any gap in them must be taken with a pinch of salt.

World Peace Through Law

On February 28, 2008, I wrote a note in a hurry for three eminent Pakistani lawyers visiting Philadelphia that day.   The note was very personal as it laid out a brief synopsis of the history of Pakistan from 1947.   Military generals periodically were supported by some civilian henchmen to run all affairs.   They imposed martial laws abrogating and crucifying one Constitution after another, enforced regulations like the 1974 amendments, enacted laws like Goonda Ordinances, Ordinance XX of 1984 and Anti-terrorist Act of mid 1990’s providing inter alia the following.

  •  §5 – Use of force against who … in all probability is likely to commit a terrorist act or scheduled offense.
  • §5.2- Arrest without warrant any person against whom a reasonable suspicion exists … to commit said offense.
  • $5.3- Enter and search without warrant any premises to make any arrest and to take possession of any property, ammunition etc… An American’s comment on this law: “Briefly the Act replaces one kind of terrorism with another and gives the Police (notorious for its corruption) and the trigger-happy soldiers the license to kill.” A federal minister publicly talked of applying the provisions of this act to implement a Master Plan aimed at a specified group (name intentionally withheld).

What did not work this time was the loud-mouth, 24/7 rhetoric’s on solving country’s problems by the Military men with show of force, guns and uniforms who did their utmost to set up their legacies and perpetuate dynasties.   They used the bubbling lava of religious fanaticism and intolerance to martial majority’s support and oppress the minorities while under the table making as much money as fast as they could.   Little peace or comfort came to ordinary citizens.   So brewed the 2007 nationwide protest for violating the judiciary.   Commentator Chris Mathews said “well-dressed middle-class intelligentsia” of the suited booted lawyers protesting in streets and being brutalized by the police was what the world had not seen before on TV.   The protest succeeded.   The course of events in Pakistan was changed.   Indeed the good lawyers, judges, juries and jurists can lead to peace anywhere by enacting fair laws and enforcing them equitably.

What did not work in the past was bad unjust laws fabricated to oppress a segment of the people.   The earliest known example is when after Abraham his followers legalized and clergy anointed a division of their society.   Brahmans were sanctified to only worship.   Kashutries or Chuttries were reserved to only earn money by doing business.   Warriors or Vaish were glorified to only fight and enforce law and order.   And the remaining dubbed as Untouchables Achoot or Chooders were condemned eternally to serve menially all upper classes, perpetually, generation after generation without ever breaking the cycle.   East India Company followed by the British enacted laws in establishing a worldwide empire on which ‘Sun never set’.   Adolph Hitler made laws to burn alive many for just being born to Jewish parents.

What will never bring world peace is the patriotism shown by world powers by enacting laws similar to Pakistan’s Anti-terrorist Act that was used against its own justice-seeking judges and jurists.   All such attempts towards that goal by war-mongers, super conquerors, religious zealots, clandestine organizations or dollar-doling super-powers seeking world-domination through lawlessness, brute strength, invading sovereign nations, establishing empires or establishing overseas-bases have failed and will always fail.   One does not have to be a genius or rocket scientist to recognize that a law is bad when it mandates doing something bad or prohibit doing something good.

What will work are laws which are fair, just and equitable for everyone.   Some good rules recognized as the ‘complete, perfect’ or apex in the arena which I advocate are as follows.

1.   The Holy Qor-aan (002:214) provides that God sent messengers bearing good news and warnings and revealed to them the Code with sound reasoning and for people to decide issues and that He guides to right road whomever He chooses.   All men are created equal and their affairs get resolved the best when they bring them to the table to analyze,  compare, dissect, discuss, negotiate settlements and just decisions without being unfair to anyone.   The rights, obligations and privileges of all persons, groups and communities merit equal protection under the law.

2.   Be good ourselves if we want good leaders to rise and ‘serve’ us.   Hilakoo Khan ravished Baghdad in 13th century.   To humiliate the conquered even more he ordered to tie the invaders’ horses in the courtyard of the biggest mosque.   Moslems came to the their Imam asking for prayers to destroy enemy.   The Imam said, “He is God’s wrath.”   When the report reached Hilakoo with the recommendation to kill that Imam, he said, “No.  Let him keep saying that.  Frightening people is good; that way they won’t rebel against us.” Scaring people keeps them subdued, doing wrong perpetuates wrongdoing, and history goes on repeating itself.   We the lawyers must do what we can and bear in mind that the biggest of the criminals reach the top to make schemes (006:124) and it is the wrongdoers who gain control over others of their own kind (006:130).

3.   Laws must be made to protect and not usurp others’ rights in their family, friend and fortunes.   When a lower class Pakistani woman was ordered to be gang-raped in punishment for her brother’s alleged love for an upper class girl, we saw injustice.   When an Afghan’s killing his wife entailed freedom after a few month’s jail-time but an Afghan woman was publicly executed with a bullet in her head for alleged immorality, everyone saw the dual standards applied.   When an Arab rape-victim was sentenced to flogging and jail-time, it showed the local judiciary’s unfairness.     When a judge posted as Attorney General justified water-boarding, it showed serious erosion of fairness and justice.   When millions in jails were executed regardless of their post-conviction or Pendente Lite status, it showed Chinese sense of justice differed from that of the west.   Peace in one world will come when we abide by the same one set of fair rules and a uniform standard of justice.

4.   Are the hunger, poverty, disease, nationalism and greed for more, the biggest problems the world faces today?   Empirical designs demonstrated by grabbing riches and resources of other nations led to WWI.   Disregard for other nations’ sovereignty precipitated WWII.   Some world leaders have often threatened to start WWIII.   The problems emanate when big powers at their whim ignore plebiscites, at their choice label others as rogue nations, and with their jaundiced eyes see their citizenry entitled to more than other countries’ citizens who grow food, produce oil or dig out minerals.   What caused the demise of League of Nations and is undermining UNO today are not the bad rules and regulations; it’s the lack of respect for and adherence to them.   And laws must be amended when poor results of a prior law necessitate a change.

5.   In 1975, Lahore High Court Bar deputed me to attend the World Peace through Law Center in Washington, DC.   Thirty-three (33) years later the progress is that the world is still clamoring for those lofty goals.   Disease, poverty, education, jobs and economic imbalances that used to be the slogans in the developing countries are the main kick balls in the elections of world powers such as in USA right now.   Clergy of leading world religions has moved their congregations to more conflicting, clashing and crushing environment.   Natural clematis whether cyclical or man-caused have created unique situations like the Lake Oral that has shrunk at places 70 miles away from its former shores in just one-half century.   After oil, is the water shortage going to be the next big thing for nations to strike at each other and destroy life by the millions, may be billions?   At least one magazine the “Wired” did state so in early 2000’s.   And I cite the Holy Qor-aan (067:031) to ask: ‘Who will bring you fresh water if the water you have is gone?’

6.   We have two alternatives before us.   We continue to abstain from getting together to make fair and just laws protecting all conflicting rights and obligations.   And we continue to flagrantly violate the few sets of rules that we have in the form of Geneva Conventions, United Nations and their affiliates.   And we continue to add new problems to the old ones like the atomic energy discovered in mid 1940’s, computer technology harnessed in mid 1970’s and instant communications we now enjoy worldwide.   And we continue to shut ourselves from talking and settling with others whom we assume to be our enemies or friends of our enemies.   And we continue to multiply international, national, local and tribal conflicts not by facing but fanning them, not by diffusing but by dispersing them all around in wider circles.   And we continue to sidestep taking concrete steps to co-exist.   And we continue to let western media use “Islamic fascism” or “Islamic terrorism” as the root of all evil and with that infuriating label insult and anger 1.5 billion Moslems in the world.   And we continue letting the East decry western capitalism while an out-of-control greedy maniac there tries to dominate world with its vision of democracy.   And we continue to ignore Israel, Kashmir, Palestine, Taiwan and hundreds of other regional cancerous situations and warring elements.   And we continue to allow religious fanatics in almost every country to pollute politics by buying politicians begging for votes to get and stay in power.   And we continue to let mighty multi-national corporations cross national borders to make more profits by cigarettes breeding diseases, munitions multiplying crime, sub-standard manufacturing spreading disease and offer luring short-cuts to man’s destruction.   And we continue to suffer from suicide bombings like the one that killed Benazir Bhutto a few weeks ago, killed 25 mourners in a funeral this morning in Pakistan and thousands others in Israel, Iraq and World Trade Center.   And we continue to wait for some Messiah to descend from the skies and fight our battles in the Apocalyptic.

Or should we take steps for fairness on all individual, geographical, national and international levels?    I believe this alternative is better and we can pursue that.   Because if we don’t, the world we leave behind for our children and grandchildren will be far, far worse than the one we inherited from our forefathers.   Good laws in the hands of good lawyers is what we need.   Let’s give it to the world.

وَقَالُوۡا لَنۡ تَمَسَّنَا النَّارُ اِلَّاۤ اَيَّامًا مَّعۡدُوۡدَةً ‌ؕ قُلۡ اَتَّخَذۡتُمۡ عِنۡدَ اللّٰهِ عَهۡدًا فَلَنۡ يُّخۡلِفَ اللّٰهُ عَهۡدَهٗۤ‌ اَمۡ تَقُوۡلُوۡنَ عَلَى اللّٰهِ مَا لَا تَعۡلَمُوۡنَ‏

 

Wa-qaa-loo-lun-ta-mus-sa-nun-naa-ro-il-laa-auy-yaa-mum-mau-doo-dah
Qool-ut-ta-khuz-toom-in-dul-laa-hay-ah-dun
Fa-lun-yookh-lay-ful-laa-ho-ah-da-hoo
Um-ta-qoo-loo-na-aa-lul-laa-hay-maa-laa-tau-la-moo-n.

 

And they said, “The fire is not going to touch us except for a few days.”
You ask, “Have you taken a promise from Allah?
Then He will not violate His promise.
Or do you say about Allah what you do not know?”
