Jihad defined by Pakistan’s High Court

LAW

JIHAD
Defined by the West Pakistan HighCourt

Report of the Court of Inquiry constituted under Punjab Act II of 1954 to inquire into the Punjab Disturbances of 1953 – Published by the Superintendent, Government Printing Press, Punjab. 1954. Part IV

“There are various theories about Jihad which vary from the crude notion of a megalomaniac moved by religious frenzy going out armed with sword and indiscriminately slaughtering non-Muslims in the belief that if he dies in the combat he becomes a shahid and if he succeeds in killing attains the status of a ghazi, to the conception that a Musalman throughout his life is pitted against kufr, kufr here being used in the sense of evil and wrong, and that his principal activity in life is to strive by argument and where necessary by force to spread Islam until it becomes a world religion. In the later case he fights not for any personal end but because he considers such strife as a duty and an obligation which he owes to Allah and the only recompense for which is the pleasure of Allah” (p 222)… “Generally accepted view is that (9:5) abrogated the earlier verses revealed in Mecca which permitted the killing of kuffar only in self defense. As against this the Ahmadis believe that no verse of the Qur’an was abrogated by another verse .. that both sets of verses have different scopes and can stand together.. that the doctrine of Nasikh and Munsukh is opposed to the belief in the existence of an original scripture” (pp 223-224).

“We are wholly incompetent to pronounce on the result to which the doctrine of Jihad will lead if, as appears from … writings produced before us including one by Maulana Abul Ala Maudoodi and another by Maulana Shabbir Ahmad Usmani, it involves the spread of Islam by arms and conquest. ‘AGGRESSION’ and ‘GENOCIDE’ are now offences against humanity for which under sentences pronounced by different International Tribunals at Nuremburg and Tokio the war lords of Germany and Japan had to forfeit their lives. And there is hardly any difference between the offences of ‘aggression’ and ‘genocide’ on the one hand and the doctrine of spread of Islam by arms and conquest on the other” (p 224).

“Each of the verses in Soorut-ul-Kafiroon which contains thirty words and no verse exceeds six words, brings out a fundamental trait in man engrained in him since his creation while the La Ikraha verse, the relevant portion of which contains only nine words, states the rule of responsibility of the mind with a precision that cannot be surpassed.  Both of these texts which are an early part of the Revelation are, individually and collectively, the foundation of that principle which human society, after centuries of conflict, hatred and bloodshed, has adopted in defining one of the most important fundamental rights of man.   But our doctors would never disassociate chauvinism from Islam” (p 220).

“As to the doctrine of Jihad, the Ahmadi view is that what is called jihad-bis-saif is permissible only in self defense and that in stating his own view on this question Mirza Ghulam Ahmad merely expounded a doctrine which is based on, and directly follows from, the several texts in the Qur’an and that he did not profess to repeal or abrogate any rule or injunction of the Qur’an” (p 192).

19. The day the trumpet will be blown and you will come in big waves

37. A reward from your God, a grant accurately measured.
38. The Lord God of the heavens and earth and what is between those two is the Most Beneficent God. Yet they won’t have any authority from Him to address Him.
39. On that day the Spirit and the angels would stand in rows. They won’t speak except anyone whom the Most Beneficent God permits. And He would say what is right.
40. That is the day of the Truth.. So whoever chose could take a turn to his God.
41. We surely have warned you of a nearby punishment. That day everyone will see what both his hands had forwarded. And the disbeliever would say, “I wish I was dust.”

The Holy Qor-aan                                       078:001                                   ○بِسۡمِ اللهِ الرَّحۡمٰنِ الرَّحِيۡمِ‏‏

With the name of Allah, the most Beneficent, the most Merciful I begin.

               Um-ma-ya-ta-saa-aa-loo-n

About what they ask one another

  • عَمَّ Um-ma About what (= Combination of 2 words. The 1st word عَنۡ (un) means ‘about, concerning, regarding or relative to’. The 2nd word مَاۤ (maa) means ‘all that, whatever, whatsoever or what.’ The combinationعَمَّا (um-maa) of which the
abbreviated is عَمّ (umma) means ‘about what; as regards; concerning; regarding; relative to all that; whereof.”
  • يَتَسَآءَلُوۡنَ — Ya-ta-saa-aloo-n — They ask (= Inquire; interrogate; question; seek info. The verse refers to the disbelievers who ask that way )

The Holy Qor-aan                                         078:003                                              عَنِ النَّبَاِ الۡعَظِيۡمِ ۙ

                Aa-nin-na-ba-il-azee-m

                About the Great Event

  • عَنِ — Aa-nin — About (= About; concerning; regarding; relative to)
  • النَّبَاِ — Na-ba-i…(l) — Event (= Announcement; happening; news; occurrence; tiding)
  • الۡعَظِيۡمِ‏ — Azee-m — Great (= As a n., it tells of (a) a person, place, time, condition or    situation that good, great, superb, fabulous, fantastic, terrific and wonderful packed with the concepts of awe, might and glory, and (b) the opposite thereof in someone something that is bad and not good.  As an adj., or adv., it accentuates the good by translations with exceedingly, extremely, immensely, incredibly or infinitely, as also  its opposite to describe the bad with translations such as abjectly, awfully, deplorably, disgustingly, dreadfully, frightfully or terribly, etc. See Note 003:173a)

* Note 078:003. This event was the “Islamic Monotheism, the Qur’an which Prophet Muhammad s.a.w brought and the Day of Resurrection” – Dr Khan and Dr Al-Hilali.

The Holy Qor-aan                                         078:004                                       الَّذِىۡ هُمۡ فِيۡهِ مُخۡتَلِفُوۡنَ ؕ‏

                Ul-la-zee-hoom-fee-hay-mookh-ta-lay-foon

               That in which they differ

  • الَّذِىۡ –Ul-la-zee That (= s., m., 3rd person. That one article, thing or person)
  • ھُمۡ‌ — Hoom — They (= pro., pl., m., 3rd person. Refers to the ‘disputants’)
  • فِىۡ — Fee — In (= About; concerning; for the sake of; in reference to; pursuant to; regarding; relative to)
  • هِ — Hay — It / which (= pro., s., m., 3rd person. Refers to the ‘Great News’)
  • مُخۡتَلِفُوۡنَ — Mookh-ta-lay-foon — Differ * (= Conflict; contradicting each other; disagree; dispute. The disbelievers differing with the believers and also among themselves.

* Note 078:004. This verse refers to those who used to ‘differ’ regarding the life after death and questioned one another by way of either soliciting for actual information or just commenting by way of sarcasm.

The Note 5889 by A Yusuf Ali elaborating this issue states that “There is practically nothing about the Resurrection in the Old Testament,” very little in the “early Christian Church,” and “the idea of a future life – if any – varied from place to place and from time to time.”

But the Holy Qor-aan verse 026:082 [where Abraham talks about the Almighty God that “He is going to cause my death and then give me life again”] clearly separates Islaam from other religions and scriptures on this issue. Moslems do not differ regarding the ‘Life After Death’ as this belief is set in the 5 Acts of worships or pillars of Islam.

* Note 078:005. The word  كَلَّا  appears to be the combination of two words. كَ means ‘like or as if.’ لَّا means No, not, never. Jointly it means ‘Absolutely not, by no means, indeed, in effect; instead; it cannot be, like it was never, nay, the fact is; the reality is, this should not have been so)

The Holy Qor-aan                                         078:006                                              ۙ‏  ثُمَّ كَلَّا سَيَعۡلَمُوۡنَ

The Holy Qor-aan                                         078:007                                      اَلَمۡ نَجۡعَلِ الۡاَرۡضَ مِهٰدًا ۙ

               Aa  laum  nauj-aa-lay  il-aur-dza  may-haa-daun

  • اَ — Aa — Do (= Question mark like Are, Can, Have, Shell or Will?)
  • لَمۡ — Laum — Not (= Never; no, not at all)
  • نَجۡعَلِ — Nauj-aa-lay … (il) — We Make (= v., pres., pl., 1st person. Appoint; assign; bring into  being; create; design; fashion; form; set up. In Arabic grammar a verb in the present tense when preceded by لَمۡ (= laum) as in this verse accurately conveys its sense by translating it as if it were a verb in the past tense.  See Note 001:007)
  • الۡاَرۡضَ — Ur-dza — Earth (= n., Area; country; earth; ground; land; soil; territory
    Also, life on earth. )
  • مِهٰدًا — May-haa-daun — Bed (= n., An abode, bedstead, home, house or residence for long or indefinite period or a hotel, inn or resting place for a brief or definite duration)

* Note 078:007. The word  الۡمَهۡدِ (= mauh-day as in 003:047, 005:111) is in the singular. It is best translated as a bed, bedstead, couch, cot, cradle, crib, divan or spread.

The word  مِهٰدًا  (= may-haa-daun as in 078:007, 002:207, 003:198) is the plural. It is best translated as a point or place of an assembly or collection of many  الۡمَهۡدbeds. It can be for an indefinite, long, permanent or ultimate period like an abode, home, house or residence. Or it can be for a brief, definite, fixed or short duration like a hotel, inn or resting place.

There are other Arabic words like the singular  عبد  (= Aub-doon that means one slave)   which by adding an ا becomes عباد (= Ibaa-doon that means many slaves)

Almighty God created earth to serv as a bed, cot, cradle, crib, expanse or spread and stabilized it by planting mountains in it as bulwarks, pegs, pillars or stakes. He told this reality repeatedly in different contexts like in 002:023, 013:004, 015:020, 016:016, 078:007/008.

The Holy Qor-aan                                         078:009                                              وَّخَلَقۡنٰكُمۡ اَزۡوَاجًا

                Wa  kha-lauq  naa  koom  auz-waa-jaun

And We created you as Spouses

  • وَّ — Wa — And (= Conj., It links words, phrases or clauses. See ‏ ‏ وَّ above)
  • خَلَقۡ — Kha-lauq — Created (= v., past., pl., 1st person. This word is a combination of two words. The first word is خَلَقۡ (= kha-la-qa = v., past.,  s., 3rd person) which on its own means He brought into being, created in due proportion, designed from scratch out of nothing, fashioned, formed, gave form and face, produced or shape. The second word is  نَآ  (= naa,= pro., pl., 1st person) and means we or us, but used with the name of God reflects the authoritative way a higher-up talks to a subordinate. When joined the combination is turned into a 1st person’s act. See Note 001:007)

See above 078:028 for a different shade of the meanings of this word)

*Note 078:037. The word حِسَابًا (hay-saa-baa) literally means ‘appropriately, equally or properly counted and balanced account’, ‘in equal balance commensurate with the work done.’ The same one word has been used to convey two different shades of its meanings as given in the verses 078:028 and 078:037.

And there is another, almost opposite meanings of this word as a ‘characteristic of the spoken language or of writing that is used to create the effect of conversation.’ Colloquially and customarily it conveys being ‘Beyond measurements’ and ‘over and above the balanced, equal or normal reward.’ In this sense it conforms to the Hadeeth that Islam dismantles and demolishes the previous evil deeds and so do the migration for Allah’s sake and Hujj (pilgrimage to Makkah) as reported in the Sahih Muslim. Other Hadeeth have reported that sincerely embracing Islam begets rewards from ten to seven hundred times.

** Note 078:039b. The Holy spirit and Angels are mentioned in the first part of this verse; so it is logical that God’s permission to speak to Him would also refer to them. But a different translation was given as “None shall speak except (Muhammad) to whom the Most Gracious (God) will grant permission and who will speak (only) what is right.”

The Holy Spirit

The (Holy) Spirit

The verse 017:086 tells of a question people ask about the Spirit and provides an answer that this “Matter lies in the domain of Allah and you are not given its knowledge except a little.”

One question is answered by mentioning that the Spirit and the angels a) would ‘stand in rows‘ (078:039) on that day before the Almighty God, b) are ‘sent to His servants‘ (016:003), do c) ‘ascend to Him‘ (070:005) and d) ‘descend to the earth‘ (097:005). Such descriptions clearly show the Spirit as the Chief of the Angels who like an army General is in the lead while other angels stand behind their leader like the soldiers — in rows and according to their ranks.

Another question for which the Almighty God provided a limited information to humans is as follows.
a. It is part of Him (019:018).
b. It comes from Him (015:030, 038,073).
c. It has come to ‘you’ (042:053).
d. It is breathed in man when balancing him with the hearing, seeing and a heart (032:010)
e. It came to the chaste woman (021:092) named Mary (004:172).

Translations have generally agreed that the said ‘Spirit’ is also called the ‘Trusted’ Spirit which poured this [The Holy Qor-aan] into your heart (026:194) and the ‘Holy’ Spirit which has supported prophets like “Jesus son of Mary” (002:088).

Translators have disagreed on some issues. A Yusuf Ali added rise to the Judgment-Seat in his Note and overruled the dominant view. The Almighty God (after repeating some of the contents of 006:166 in 043:033) said in 043:034, “If all men were not to become of one type, He would have given His deniers silver stairs to climb up and reach Him.” Interpreting from this that the virtuous human beings become angels after dying appears a bit stretch. That is why the readers should take a pinch of salt when they come across the following words.
• The Note 2651 by M Muhammad Ali stated that the Holy Spirit was “the spirit of man when it leaves the earthly body.”
• The Note 5911 by A Yusuf Ali concluded that “It is better to take a wider meaning – the souls of men collectively as they rise to the Judgment-Seat of God.”

We have yet to come across any known divine revelation to the effect that the virtuous people turn into angels when they die. In the world of fiction, however, there was a TV series in which the spirit of an evil-doer ran amuck until it had performed a good deed, and after doing one assigned good deed the spirit of that evil-doer also turned into an angel.
